September 12, 2022, marks the 25th anniversary of the European Court of Human Rights (ECtHR) examining complaints against Moldova. In this context, the Legal Resources Centre from Moldova (CRJM) has summarized in a document all the violations committed by our country, outlining the types of violations and the judgments condemning the Republic of Moldova.
In total, the state has been convicted 568 times for 730 human rights violations. Most of the findings concern violations of the right to a fair trial. The Moldovan authorities admitted 229 violations of this right, protected by Article 6 of the Convention.
This is followed by a violation of Article 3 of the ECHR which provides for the prohibition of torture. State officials neglected this provision in 171 cases. The right to liberty and security was also violated 106 times and the right to respect for private and family life was violated in 43 cases.
”The synthesis prepared by the LRCM is an analytical effort aimed at raising society's awareness and respect for human rights, as well as increasing the level of information among specialists about Moldovan cases. We very much hope that this jurisprudence will facilitate the application of ECtHR standards at the national level and contribute to the prevention of similar violations", declared Daniel Goinic, Director of the Human Rights Programme at the LRCM.
The synthesis was developed on the basis of the study of ECtHR case law in Moldovan cases available in the Court's HUDOC database. The violations were systematised in a table according to the articles and types of violations found. In the table, under each category, all the judgments in which a violation of the same type was found are mentioned.
We want to point out that, since 2010, the CCJE has been analysing the work of the ECtHR in Moldovan cases, preparing analytical notes for each year separately: 2010, 2011, 2012, 2013, 2014, 2015, 2016, 2017, 2018, 2019, 2020, 2021.
